The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No. 243/2015 registered in Police Station Arjuni, District Dhamtari (C.G.) for offence punishable under section 306/34 of Indian Penal Code.

As per the prosecution case one Bhuneshwari committed suicide by consuming poison. She was wife of Gyaneshwar. Applicants No.1 and 2 are father-in-law and mother-in-law of the deceased. Bhuneshwari was married to Gyaneshwar who was son of first wife of Sukhlal. Gyaneshwar was also married to one Jaitri Bai. Further they could not go along Gyaneshwar performed marriage to Bhuneshwari who was married in 2015. As per prosecution applicants who are father-in-law and mother-inlaw abetted Bhuneshwari to commit suicide. 3.
Learned counsel for the applicants submits that applicants have been falsely implicated in this case and evidence is absent that applicants
have abetted the commission of crime. He further submits that charge sheet in this case has been filed, no further evidence is required and applicants are aged about 65 years and 60 years, therefore the applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
I have perused the case diary and the charge sheet. Taking into evidence available against the applicants, considering the facts and circumstances of the case and degree of allegations, charge sheet having been filed, without any observation on merit, this court is inclined to release the applicants on bail.

Accordingly, the bail application is allowed and it is directed that the applicants shall be released on each of them furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
