The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No. 47/2015 registered in Police Station Gudhiyari, Distt. Raipur (C.G.) for offence punishable under section 304-b/34 of Indian Penal Code.

As per the prosecution case, marriage of Aaradhna Updhyay was solemnized with brother of the applicant namely Shravan Kumar on 6/05/2013. It is further alleged that after marriage she was subjected to cruelty for demand of dowry, as such applicant along with other co-accused started harassing her. Consequently, she committed suicide on 15/01/2015.

Learned counsel for the applicant submits that applicant is sister-inlaw who was married and used to reside at her in-laws place and she was not inmate of the house and further submits that mother-in-law and sisterin-law both have been enlarged on bail by the coordinate bench of this court in M.Cr.C. No.968/2015 on whom severe allegations have been
made. He submits that according to the communication received applicant is suffering with complicated pregnancy and on 22/12/2015 she was subjected to check up by doctors wherein it was reported and she has been hospitalized for complication, therefore applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail, however do not dispute the fact that other co-accused have been enlarged on bail in M.Cr.C. No.968/2015.

Taking into fact that other co-accused have been enlarged on bail in M.Cr.C. No.968/2015 and further considering medical condition of the applicant and also considering the omnibus allegations against this applicant, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on her furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for her regular appearance before it as and when directed. Certified copy as per rules.
