The applicant has preferred this second bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.255/2020, registered at Police Station Baramkela, District Raigarh, C.G., for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The first bail application was dismissed as withdrawn with liberty to revive the prayer after two months. 4.

The applicant was found in illicit possession of 10 kg. Ganja when a search was made on 23-11-2020.

Learned counsel for the State, per contra, would oppose the bail application. However, he would submit that the concerned SHO has not reported any previous antecedents. 6.

Considering the fact that the applicant is in detention since 23-11-2020; the charge sheet has already been filed; and also the fact that two months period has expired after rejection of the first bail, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.1,00,000/- with two local sureties in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
