1. Heard.
2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.192/2020 registered at Police Station Rajhara District Balod (CG) for the offence punishable under Sections 294, 506, 323, 452, 435, 427 of the IPC and Sections 25, 27 of the Arms Act.
3. The applicant allegedly threatened the tenants of injured Omprakash Sahu and later on, tried to cause injuries over the person of Omprakash Sahu by brandishing a sword causing
MCRC No. 3527 of 2020 simple injuries over his head, which have been reported to be caused by a hard and blunt object.
4. Learned counsel for the applicant would submit that a minor incident has been exaggerated and a false case has been fastened upon the applicant. He would submit that in the list of three previous antecedents, the applicant has already been acquitted in two of them.
5. On the other hand, learned counsel for the State would oppose the bail application.
6. Considering the fact that the applicant is in jail since 5.5.2020; the charge sheet has been filed and; the injuries sustained by the injured have been found to be simple in nature, this Court is inclined to release the applicant on regular bail.
7. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
