1. This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court.

2. Perused the case diary provided by the learned counsel for the State in connection with the Crime No.14/2019 registered at Police Station GRP Raipur, District Raipur (C.G.) for the offence punishable under Section 363, 365 of IPC.

3. Case of the prosecution, in brief is that complainant Suman Sahu has a one month old girl namely Kavya Sahu. On 24/01/2019 applicant met with her near the stairs of Railway Station, Raipur. She had given his mobile number to complainant. On very day at 5 p.m. applicant took away her girl Kavya by concealing, thereafter that girl was seized from the possession of applicant.

4. Learned counsel for the applicant submits that she is innocent and falsely implicated in the present case, therefore, she shall be released on bail. She further submitted that if applicant wanted to take the girl why she would have given her mobile number to complainant.

5. On the other hand, counsel for the State opposes the bail application. He further submits that no criminal antecedents against the applicant.

6. Looking to the above mentioned facts and circumstances of the case, looking to the seriousness of the alleged offence, looking to the impact of granting bail to the applicant on society, the present bail application is rejected.
