(2) This Court by order dated 15.03.2016 passed in Writ Petition (S) No.798 of 2016 directed the disciplinary authority i.e. respondent No.4District Education Officer, Bemetara to do well and take decision on the pending departmental enquiry of the petitioner in accordance with law, expeditiously. Again the second writ petition has been preferred by the petitioner for seeking direction may be issued to the competent authority to decide the same, which is not maintainable.

(3) However, respondent No.4 i.e. District Education Officer, Bemetara is directed to explain as to why the order of this Court dated 15.03.2016 has not been complied with in its letter and spirit. Respondent No.3 i.e. Collector, Bemetara is directed to ensure the order of this Court dated 15.03.2016 is complied with expeditiously and decision be taken on the pending departmental enquiry of the petitioner without further loss of time and the suspension allowance, if any, is to be paid to the petitioner.
