Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 12/07/2016 With the consent of the parties, the matter is heard finally. Learned counsel for the petitioner submits that prayer for urgent hearing has been made for disposal of the matter on the ground that identical petition has already been decided by order dated 23.04.2015 (Annexure P/8) and 23.03.2015 (Annexure P/9).
Learned counsel for respondent No.2 submits that the legal position adumbrated in the aforesaid two orders, shall also be applied to the case of the petitioner upon due verification of the facts of the case of the petitioner for consideration of his claim of parity.
In view of the statement made by learned counsel for respondent No.2, this petition, at this stage, is also disposed off with a direction to consider the case of the petitioner on similar lines as the order passed by this Court vide order dated 23.04.2015 in Writ Appeal No.231 of 2015 (Dharmendra Kumar Patel and others Vs. State of Chhattisgarh and others) and order dated 23.03.2015 passed in Writ Appeal No.389 of 2014 (Smt. Gayatri Maitri Vs. State of Chhattisgarh and others).
