Shri Jitendra Nath Nande, learned counsel for the petitioner after arguing for sometime, seeks permission of this Court for withdrawal of this writ petition with liberty to file a representation before the 3rd respondent raising all his

grievances. He submits that a direction may be issued to the 3rd respondent to consider and decide the representation to be submitted by the petitioner expeditiously. 2.

Shri Ashish Tiwari, learned Government Advocate representing the State submits that impugned order has been passed by respondent No.3 and he is not having any objection if the petitioner makes a representation before the 3rd respondent.

Accordingly, the writ petition is dismissed as withdrawn with aforesaid liberty. In the event, petitioner files a representation before the 3rd respondent, the 3rd respondent shall consider and decide the same within a period of four weeks from the date of receipt of representation. 4.

It is made clear that this Court has not made any observation with regard to merits of the case and it is for the 3rd respondent to consider and decide the representation of the petitioner on its own merit.
