2) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 18/05/2021 in connection with Crime No. 34/2021 registered at Police Station Seepat, District Bilaspur (C.G.) for the offence punishable under Section 306 of the Indian Penal Code.

3) Learned counsel for the applicant seeks to withdraw this bail application with liberty to file a fresh application as and when occasion arises.

4) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
