Sam Koshy Order On Board 20/02/2017 The present contempt case has been filed seeking for initiating contempt proceedings against the respondent for the alleged deliberate and willful non-compliance of the order dated 27.11.2015 passed by this Court in W. P. (S) No. 6160/2007. 2.
The direction in this case was that the respondent shall open the sealed cover envelop pertaining to the recommendations made by the DPC in respect of the petitioner which was held in the year 1998-99. The respondent has filed their reply and has also enclosed the recommendation of the DPC which reflects that the petitioner in the instant case was not found suitable for promotion. 3.
In view of the fact that the sealed cover envelop has been opened and the recommendation of the DPC was not in favour of the petitioner, this Court is of the opinion that no contempt proceeding is made out against the respondent.

Accordingly, the present contempt case stands rejected. 5.
However, the petitioner is not precluded to initiate a fresh petition for redressal of his grievance in the light of the recommendations made by the DPC.
