1. The applicant has preferred this second bail application under Section 439 of Cr.P.C. as he is in jail since 02.12.2020 in connection with Crime No. 587/2020 registered in Police Station City Kotwali, District Rajnandgaon (C.G.) for the offence punishable under Sections 363, 366, 419, 370(4) read with Section 34 of IPC.

2. The first bail application of the applicant was dismissed on merits vide order dated 10.02.2021 passed in M.Cr.C. No. 124/2021 by this Court.

3. Learned counsel for the applicant seeks to withdraw this second application with liberty to file a fresh application as and when occasion arises.

4. Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
