The applicants have preferred this second bail application under Section 439 of the Cr.P.C. for grant of bail as they have

MCRC No.3458 of 2021 been arrested in connection with Crime No.190/2020, registered at Police Station Sariya, District Raigarh C.G., for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The first bail application was dismissed on merits reserving liberty in favour of the applicants to revive the prayer at an appropriate stage.

Three accused persons have been arrested for illicit possession of 20 kgs. of cannabis plants.

Learned counsel for the applicants would submit that if the alleged ganja was transported jointly the same would not be more than the commercial quantity. The applicants are in jail since 11-11-2020.

Considering the length of pre-trial detention and for the fact that the illicit ganja has been recovered from three accused persons, I am of the opinion that present is a fit case to release the applicants on regular bail.

Accordingly, the bail application is allowed and all the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.1,00,000/- with two local sureties in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court. 8.
