Learned counsel for the applicants submits that applicant no. 2/ Rahul Dev Singh and applicant no. 3/ Kanhaiya Rajput were arrested during the pendency of this bail application, hence, the application with regard to applicants 2 and 3 is not pressed.

Mr. Ishwar Jaiswal, learned counsel for the applicants seeks permission of this Court to withdraw the bail application of applicant no. 1. However, he submits that as applicant no. 1 is an old age person, a direction be issued to the Trial court concerned to consider regular bail application filed by applicant no. 1 on the same day he surrenders.

Learned State counsel submits that he is having no objection to the prayer made by learned counsel for the applicants. 5.
Accordingly, bail application is dismissed as withdrawn. Learned Court below may consider and decide the bail application for grant of regular bail if filed by applicant after his surrender on same day in accordance with law.
