Heard Learned counsel for the petitioner submits that in view of the law laid down in case of State of Maharashtra & Ors v. M/s Ark Builders Pvt. Ltd. reported in AIR 2011 SC 1374, he wants to withdraw this petition to challenge the execution proceeding itself on the ground that the signed copy of the award has not been delivered to the petitioner by the Arbitrator.

In view of the above, the petition is dismissed as withdrawn. However, the petitioner would be at liberty to challenge the execution proceeding as aforesaid.
