Apprehending arrest in connection with S.T. No.19/2017 arising out of the Crime No.154/2017, pending before Additional Sessions Judge, Khairagarh, District - Rajnandgaon (C.G.) for offence punishable under Section 436 of the Indian Penal Code, the applicant has preferred this application for grant of anticipatory bail. 2.

It is submitted by the learned counsel for the applicant that this applicant was earlier granted regular bail by this Court in M.Cr.C. No.6583/2017 by order dated 07.12.2017. In the pending case, this applicant failed to appear on one date i.e. why warrant of his arrest is issued against him and he is apprehending arrest. Therefore, it is prayed that the applicant may be granted anticipatory bail.

Per contra learned State counsel opposes the application for grant of bail and the submissions made in this respect. 4.

As the order of the Coordinate Bench of this Court in M.Cr.C. No.6583/2017 dated 07.12.2017 is still existing and having the force, therefore, in case the applicant gives his appearance before the Court below, the Court below is bound to release the applicant on his furnishing bail bonds as per the order in M.Cr.C.
