1. By the impugned order, application under Order 9 Rule 13 of the CPC has been rejected by the trial Court.

2. The order would be appealable under Order 43 Rule 1 (d) of the CPC, as such, the present writ petition cannot be entertained. However, the petitioner is at liberty to file appeal in accordance with law.

3. Accordingly, the present writ petition is disposed of as not maintainable. Certified copy of the impugned order be returned to counsel for the petitioner after furnishing duly attested photocopy thereof to file appeal, if any.

Certified copy today itself.
