The applicant has preferred this bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No. 48/2018, registered at Police Station Chowki C.S.E.B. P.S. Kotwali Korba, District Korba (C.G.) for the offence punishable under Sections 457, 380 of Indian Penal Code.

The applicant has allegedly committed lurking house trespass and theft of Golden ornaments, laptop, mobile sets etc. from the house of complainant Hussain.

Considering the entire facts of the case and also the fact that the applicant is in jail since 04.02.2018 i.e. for more than three months and the charge-sheet has already been filed and also for the reason that the
offences are triable before Judicial Magistrate First Class and there is no previous antecedents of the applicant, this Court is inclined to release the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
