This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.

The applicant has been arrested in connection with Crime No.42/2019 registered in Police Station Jhagrakhand, District Korea (C.G.) for the offence punishable under Section 34(2) of CG Excise Act. 3.

Argument heard.

Case of the prosecution, in brief is that on 13/03/2019, 20 bulk liters of hand made country liquor has been seized from the possession of the applicant. 5.

Counsel for the State submits that one another criminal case under Excise Act has been registered against the applicant. 6.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if the applicant furnishes two solvent sureties each for a sum of Rs. 25,000/- along with one personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned with the condition that he will not involve himself in any of the crime in future, he be released on bail. 7.
