(2) Learned counsel appearing for the petitioner submits that the petitioner is working as Lab Technician in Community Health Centre, Pithora and he has been transferred from Community Health Centre Pithora, Block Pithora, District Mahasamund to Primary Health Centre, Bhurkoni, Block Pithora by the impugned order dated 23.11.2015

passed by respondent No.3-Collector, Mahasamund, which is contrary to the rationalization policy, against which, he may be permitted to make a representation before the respondent No.3 i.e. Collector, Mahasamund, to which, counsel for the State has no objection. (3) Prayer appears to be fair and reasonable.

(4) The petitioner is permitted to make a representation before the respondent No.3-Collector, Mahasamund. If such representation is made by the petitioner within a period of 15 days from today before the said authority, the authority shall consider and decide the same on its own merit and in accordance with law preferably within a period of 30 days from the date of receipt of representation of the petitioner. (5) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
