This contempt petition has been filed by the petitioner on the allegation that despite order dated 26.07.2016 passed by this Court, which was submitted before the respondent as back as on 11.08.2016, till date, no decision has been taken in the case of the petitioner. 2.
I find that this Court had directed the respondent to examine the proposal of the Divisional Forest Officer and take appropriate decision on the petitioner's case for regularization, strictly in accordance with policy of State Government dated 05.03.2008 and the judgment of the Supreme Court in the case of the Secretary, State of Karnataka and others vs. Uma Devi and Others, AIR 2006 SC 1806. Even though, no specific time limit was fixed, the respondent was obliged to take appropriate decision in the matter one way or the other within the reasonable time. More than five months have elapsed since the order was served on the respondent. Therefore, it is high time the respondent should take appropriate decision within a period of 30 days from the date of receipt of copy of this order, failing which the petitioner would be at liberty to revive the contempt petition and non-compliance of the order of the
Court shall be viewed strictly.
