The applicant has preferred this bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No. 713/2017, registered at Police Station Kotwali, Ambikapur, District Surguja (C.G.) for the offence punishable under Sections 323, 307, 394, 397, 398 and 120-B of Indian Penal Code and Sections 25 & 27 of the Arms Act. 2.

The applicant has allegedly committed loot and attacked on life of the complainant Ankur Garg at about 9:15 p.m. on 29.11.2017. At the time of incident, the complainant was returning from his shop. When he was nearing home, the present applicant along with co-accused Bajru and two other persons committed the offence of looting cash amount of Rs. 6,00,000/-,

ledger account, keys of the shop and godown, four cheque books and two mobile sets. During interrogation, the applicant informed the police that on opening the bag there was no cash amount inside the bag. Resultantly, no amount has been recovered from the accused persons. 3.

Considering the entire facts of the case that the injured has not sustained any grievous injury and the applicant is in jail since 01.01.2018, investigation has been completed and charge-sheet has already been filed, the present is considered to be a fit case for release of the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
