Versus
• Smt. Pragya Rani Gupta W/o Amit Kumar Gupta, Aged About 32 Years R/o A.B.T. College, Gali No 07, Kududand Bilaspur District Bilaspur Chhattisgarh ---- Respondent For Petitioner :
Shri Sanjay Patel, Advocate Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 26/10/2016
1. The present petition under Article 227 of the Constitution of India has been preferred to assail the order passed by the Family Court, whereby the respondent has been allowed interim maintenance of Rs.10,000/- per month together with one time litigation expenses of Rs.10,000/-.
2. It is argued that the respondent was working as Assistant Professor in the Shri Siddh Peeth Mahamaya Education College, Bilaspur, therefore, she having her own independent income is not entitled to interim maintenance.
3. The document Annexure P-5 would reveal that the respondent has resigned from her job on 16.08.2016, which has been accepted by the management of the College.
4. In view of the document Annexure P-5, it cannot be concluded at this stage that the respondent has her own independent income. The matter being interim in nature, no interference with the impugned order is called for. The trial Court is directed to conclude the trial at the earliest, preferably within a period of six months from the date of submission of certified copy of this order.
5. Accordingly, the writ petition stands disposed of. Sd/- Judge Prashant Kumar Mishra ashu
