Hon'ble Shri Justice Goutam Bhaduri Order 23/06/20 Heard.

1. Grievance of the petitioner is that the petitioner was initially appointed as a peon on 27/06/2008. Subsequently he was promoted to the post of Assistant Grade-III on 18/09/2018 and worked for last more than 10 years without any complaint. Therefore it is contended that the petitioner has made an application to be considered for promotion before respondent No.2, Chief Municipal Officer, Municipal Council, Jashpurnagar, same may be directed to be considered.

2. Perused the documents. Only prayer of the petitioner is that he is working in

the post of Assistant Grade-III since 2018 and he is not been considered for promotion. Petitioner since has made an application to the respondent No.2, Chief Municipal Officer, Municipal Council, Jashpurnagar it would be just and proper to direct respondent No.2 to consider the application of the petitioner for consideration of the promotion to the next higher post. Therefore, it is directed that respondent No.2, Chief Municipal Officer, Municipal Council, Jashpurnagar shall decide the representation of the petitioner within a period of four months from the date of receipt of this order. Thereafter if the petitioner is found eligible, he may be considered on its own merit to be promoted to the next higher post. It is made clear that this court has not made any observation on the merit about the eligibility of the petitioner for promotion.
