Present writ petition has been filed by the petitioner. The grievance of the petitioner is that he is going to retire on attaining the age of Superannuation w.e.f. 30.09.2017 and that he may not be considered for grant of pension under the work charged and contingency under the new pension scheme, 2004. 2.
Without going into the merits of the case this Court is of the opinion that, present writ petition may not consider at this stage for the reason that, allegations and contentions put forth by the petitioner are only matter of apprehension. There is no order against the petitioner or any similarly placed persons holding that they would not be considered for pension under the work charged and contingency (pension) rules, 1979.

Petitioner even otherwise should not have any apprehension for the reason that petitioner was regularized as contingency paid employee in 2006 and would have clear more than 11 years of regular service with the respondents and which by itself would otherwise also entitled him for pension under the Work Charged and Contingency (Pension) Rules, 1979.

On consideration of the aforesaid factual matrix of the case this Court is of the opinion that, no any strong case in the present petition is made out and it deserves to be and is accordingly dismissed.
