1. The impugned order has been passed by the prescribed authority i.e. Sub Divisional Officer (Revenue) in exercise of power under Section 40 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 ('the Adhiniyam' in short).

2. The impugned order is appealable under Section 91 of the Adhiniyam read with Rule 3 of the Chhattisgarh Panchayats (Appeal and Revision) Rules, 1995.

3. In view of availability of alternative remedy, the writ petition is not maintainable. It is accordingly disposed of with liberty to the petitioner to avail the alternative remedy within a period of 30 days.
