Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 24/09/2021 Heard.

1. This is repeat application for grant of bail. Earlier bail application was rejected on merits.

2. The applicant has moved this application for grant of bail as he is arrested in connection with Crime No.241/2020 registered at Police Station- Chakarbhata, District : Bilaspur, C.G. for the alleged commission of offence under Sections 21 & 22 of NDPS Act.

3. Learned counsel for the applicant would submit that the present application has been filed only on medical ground by submitting that the applicant is suffering from medical ailment and has been advised surgery.

4. On the other hand, learned State Counsel would submit that he would not dispute the statement made regarding requirement of applicant needing a surgery. He, however, submits that the surgery is not very complicated one.

5. I have perused the papers on record including the documents relating to ailment, treatment, investigation report and the opinion of the doctor. In the circumstances, this Court is inclined to grant bail to the applicant for a limited

period on medical ground. Accordingly, the bail application is allowed.

6. The applicant is granted bail for a limited period of three months from the date of release from the jail. After completion of three months, the applicant would be required to surrender before the trial Court.

7. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- along with two local sureties of the like amount to the satisfaction of the Trial Court. Certified copy as per rules.
