Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 18/08/2017 This petition has been filed by the petitioner assailing correctness and validity of order dated 21/03/2017 by which, petitioner's application for compassionate appointment has been rejected.

Learned counsel for the petitioner submits that at the time when the father of the petitioner died in the year 1996, the petitioner was minor. Therefore, the application could not be made at that time. It is only when the petitioner became major, application for compassionate appointment was filed. It is submitted that consistent with the policy of compassionate appointment as there was no member in the family to earn livelihood, the petitioner ought to have granted compassionate

appointment.

After considering submission of learned counsel for the petitioner and going through the impugned order, this Court is not inclined to grant any relief to the petitioner because it is a very old and stale matter. The father of the petitioner died way back in the year 1996 and even according to the petitioner, the petitioner had become major in the year 2004 and the application for compassionate appointment was moved in the year 2016. Therefore, at such a belated stage, no direction can be issued for compassionate appointment of the petitioner. The petition is accordingly dismissed.
