(1) Learned counsel appearing for the petitioner submits that there are several discrepancies in the date of birth of the petitioner recorded in official record, by which he is proposed to be retired on 31.01.2016 considering his date of birth as 5.1.1956 whereas his actual date of birth is 7.1.1960. He would further submit that despite several representation, the Age Determination Committee (for short "ADC")
has not considered the case of the petitioner and has not passed any order. Thus, learned counsel prays that the case may be referred to the ADC for consideration and decision with regard to the determination of the date of birth of the petitioner. (2) In view of that, it is expedient that before the Court take up the matter, the ADC, which has been constituted for the purpose of determining the date of birth of the employees, if there are discrepancies, shall consider the case of the petitioner on merits after affording an opportunity of hearing to the petitioner and pass appropriate orders in accordance with law and on its own merits. Accordingly, the petition is disposed of.
