Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 25/08/2017 Heard.

1. The transfer order is under challenge only on the ground that the petitioner had suffered from transient Ischaemic Attack on 16.07.2017 and admitted in the hospital wherefrom he was discharged after two days.

2. Learned counsel for the petitioner submits that looking to the nature and extent illness which the petitioner is presently suffering, if he is posted to Ghotiya, he may not get proper medical facility.

3. The nature and extent of petitioner's illness can be best examined only by the doctors and on the basis of such a report, the competent authority may take a decision in the matter whether the petitioner should be posted at a place where he has been transferred or to any other place. The petitioner has already preferred representation. The competent authority may decide petitioner's representation seeking report of the competent medical officer within a period of four weeks. For a period of four weeks, no coercive steps shall be taken against the petitioner.

4. The petition is accordingly disposed off.
