1. The only ground of challenge to the transfer order is that though the petitioner has completed his normal tenure of posting, he has been transferred to Manpur and the petitioner's daughter who is deaf-and-dumb and is studying in a deaf-and-dumb school at Bhilai which is nearer to Patan as compared to Manpur.

2. As the petitioner has become due for transfer, the petitioner cannot claim to continue at Patan. However, the other difficulty stated by petitioner may require consideration whether administrative exigency permits transfer of the petitioner to some other place where similar education facility is available to the petitioner's daughter or he may be posted to any other place nearer to Bhilai.

-23. Let representation of the petitioner be decided within 4 weeks from the date of receipt of copy of this order. The petitioner shall submit copy of this order before the authority within 2 weeks from today. For a period of 6 weeks, the petitioner shall not be compelled to proceed on transfer.
