This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.

The applicant has been arrested in connection with Crime No.2/2019 registered in Police Station Excise Circle, Baradwar, District Janjgir-champa (C.G.) for the offence punishable under Section 34(1)(a), 34(2) & 59(a) of CG Excise Act.

Case of the prosecution, in brief is that on 03/04/2019, 5.76 bulk liters of country made liquor has been seized from the possession of the applicant. 5.

Counsel for the State submits that three other criminal cases have been registered against the applicant out of which one under Excise Act and two under CrPC.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if the applicant furnishes two solvent sureties each for a sum of Rs. 25,000/- along with one personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned with the condition that he will not involve himself in any of the crime in future, he be released on bail. 7.
