1. The petitioner has assailed legality and validity of order of suspension on the grounds which do not relate to absence of jurisdiction or personal malice of the authority who has issued the order.

2. The grounds raised in this petition are more on propriety aspect.

3. Learned counsel for the petitioner submits that against the order of suspension, an appeal has been preferred which has remained pending.

Therefore, the petitioner filed this petition.

4. Without commenting upon the merits of the case, taking into consideration that an appeal has been filed by the petitioner, which has remained pending without decision, it would be appropriate to dispose off the matter with the direction to respondents to consider and take decision on the petitioner's appeal against the suspension, within a period of 45 days from the date of receipt of copy of this order.
