(2) This is the third bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicants, who have been arrested in connection with Crime No.148/2015 registered at Police Station Katghora, District Korba, for the offence punishable under Sections 379/34 of the IPC and Section 385 of the Prevention of Damage to Public Property Act, 1984.
(3) The applicants' first bail application was dismissed as withdrawn
by order of this Court dated 10.08.2015 passed in M.Cr.C. No. 3920/2015 and second bail application of the applicants was dismissed on merits by order of this Court dated 02.12.2015 passed in M.Cr.C. No. 6964/2015.
(4) After hearing learned counsel appearing for the parties and taking into consideration the totality of the facts and circumstances of the case, I do not consider it a fit case to entertain the third bail application. Consequently, third bail application is rejected. (5) Certified copy as per rules.
