(2) Learned counsel for the State submits that the impugned order dated 21.10.2016 passed by respondent No.3 i.e. District Education Officer, Surajpur is appealable before the appellate authority.
(3) Learned counsel appearing for the petitioner submits that he may be permitted to withdraw the writ petition with liberty to prefer an appeal before the appellate authority within a period of two weeks from today.
(4) Prayer appears to be fair and reasonable.
(5) The petitioner is permitted to prefer an appeal before the appellate authority. If such appeal is filed by the petitioner within a period of two weeks from today and, in turn, the appellate authority shall consider and decide the same in accordance with law and on its own merit preferably within a period of two months from the date of receipt of appeal of the petitioner along with copy of this order.
(6) With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
