Hon'ble Shri Justice Goutam Bhaduri Order on Board 18.01.2016

1. This is an application filed u/s 439 of the Code of Criminal Procedure seeking granting of regular bail to the applicant in connection with Crime No. 118 of 2015 registered at Police station New Rajendra Nagar, Distt. Raipur (C.G) for the offences punishable under 420, 467, 468 IPC.

2. As per the prosecution case, the applicant in order to provide job to complainants Arun, Keshav, Ved Prakash, Pawan, Harishankar and Srikant, in Mantralaya obtained Rs.11.20 lakhs from them.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and he himself is one of the complainants against Suraj Vishwakarma and Harishankar who were owners/partners of the placement agency and they have obtained Rs.40 lakhs in order to provide jobs in Mantralaya. He further submits that the applicant was given a job in that placement agency and the owners/partners have not been made accused. It is further submitted that the charge sheet has been filed and the applicant is in jail since 20.08.2015, therefore, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the prayer for grant of

bail.

5. Perused the case diary and the statements of above complainants as also the documents which show that the applicant after receiving the amounts issued appointment orders to different persons from whom the amounts are said to have been received.

6. Taking into nature of allegations and the way in which the offence committed and after perusal of the documents collected by the prosecution, I am not inclined to release him on bail, at this stage. Accordingly, the bail application is rejected. Sd/- GOUTAM BHADURI JUDGE Rao
