Learned counsel for the appellant submits that during pendency of this appeal challenging the Family Court's judgment and decree dismissing the appellant's application for restitution of conjugal rights under Section 9 of the Hindu Marriage Act, 1955, the divorce petition preferred by the respondent has already been allowed, therefore, the instant appeal has been rendered infructuous. 3.

In view of the statement made, the appeal is dismissed as having rendered infructuous.
