1. Apprehending arrest in connection with Crime No. 27/2015 registered at Police Station Sanawal Revenue District Balrampur-Ramanujgnj Civil Distt. Surguja (C.G) for the offences punishable under section 323, 354, 394 & 452 IPC, the applicant has filed this application u/s 438 of the Code of Criminal Procedure for grant of anticipatory bail.
2. As per the prosecution case, on 06.10.2015 the applicant entered into the house of prosecutrix and tried to outrage her modesty and having refused to fulfill the desire of applicant, she was assaulted.
3. Learned counsel for the applicant submits that there was some monetary transaction between the parties and the complainant borrowed some amount from applicant and has not returned the same and on making demand to repay, false allegations have been made against him.
4. Per contra, learned State Counsel opposes the prayer for grant of bail.
5. Perused the statement of the prosecutrix as also the medical report.
6. Taking into such statement of prosecutrix along-with medical report, I am not inclined to allow the anticipatory bail application. Accordingly, it is rejected. Sd/- GOUTAM BHADURI JUDGE Rao
