(2) Learned counsel for the State submits that the impugned order dated 10.10.2016 passed by respondent No.2 i.e. Chief Medical & Health Officer, District Hospital, Bilaspur is appealable before the appellate authority.

(3) At this stage, learned counsel appearing for the petitioner submits that the impugned order dated 10.10.2016 (Annexure

P/1) passed by respondent No.2 is appealable before the appellate authority under Rule 23 of the Chhattisgarh Civil Services (Classification, Control & Appeal) Rules, 1966 (in short "the Rules, 1966") and, therefore, he may be permitted to withdraw the instant writ petition with liberty to prefer an appeal before the appellate authority within a period of three weeks from today.

(3) Prayer appears to be fair and reasonable.

(4) The petitioner is permitted to prefer an appeal before the appellate authority. If such appeal is filed by the petitioner within a period of three weeks from today and, in turn, the appellate authority shall consider and decide the same in accordance with law and on its own merit preferably within a period of three months after noticing to the parties from the date of receipt of appeal of the petitioner along with copy of this order. (5) With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
