1. Proceedings of this matter have been taken-up through video conferencing.

2. Mr. Vipin Tiwari, learned counsel appearing for the petitioner, would submit that the petitioner's earlier representation for consideration of his case for promotion on the post of Assistant Grade-III in accordance with the Chhattisgarh Lok Seva (Padonnati) Niyam, 2003 was declined to be considered on the ground that he has not completed five years of service on the post of Peon from the date of regular appointment on 27-9-2008 and thereafter on completion of five years of service, his case will be considered for promotion, but though

five years' period has already expired on 26-9-2013, yet his case has not been considered for promotion and he was not promoted, therefore he may be allowed to make fresh representation before the respondent authorities and it may be directed to be considered expeditiously.

3. Learned State counsel would submit that if proper representation is made by the petitioner, it will be considered by the competent authority in accordance with law.

4. Be that as it may, the petitioner shall make a fresh representation for his promotion before the competent authority within three weeks from today and if such representation is made, same shall be considered and decided by a reasoned and speaking order, in accordance with the applicable rules, regulations and bye-laws, within two months from the date of its receipt.

5. It is made clear that this Court has not expressed any opinion on the merits of the matter.

6. With the aforesaid direction, the writ petition stands finally disposed of. No order as to cost(s).
