Hon'ble Justice Shri Gautam Chourdiya Order on Board 22/07/2021 1) The matter is heard through Video Conferencing. 2) This is the Fourth Bail Application filed under Section 439 of Code of Criminal Procedure, 1973 for grant of bail. The First Bail Application i.e. MCRC 68/2019 was rejected on merits on 30/01/2019, the Second Bail Application i.e. MCRC No. 2540/2019 was also rejected on merits on 26/04/2019 and the Third Bail Application i.e. MCRC No. 2152/2020 was also rejected on merits on 14/07/2020.
3) The applicant is arrested on 20/10/2018 in connection with Crime No. 389/2018 registered at Police Station Ambikapur, District Surguja (C.G.) for the offence under Section 392, 394, 325 newly added Section 397 of Indian Penal Code. 4) Learned counsel for the applicant seeks to withdraw this bail application with liberty to file afresh as and when occasion arises.
5) Accordingly, the Fourth Bail Application is dismissed as withdrawn with the liberty as stated above. However, looking to the period of custody, the trial Court is directed to expedite the trial and conclude the same as early as possible. -Sd/- (Gautam Chourdiya) Judge Chandrakant
