Mr. Abhyuday Singh, Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 22.06.2021
1. The limited relief that the petitioner has sought in the present writ petition is for an appropriate direction to the respondents for ensuring timely release of the subsistence allowance payable to the petitioner.
2. According to the petitioner, it is a case where the respondents are releasing subsistence allowance at times of 2-3 months which is causing great hardship for the petitioner to sustain himself. He makes a prayer that under the service rules, the authorities are supposed to
pay the subsistence allowance every month.
3. There cannot be a dispute that the subsistence allowance has to be paid monthly. Given the said facts, the writ petition at this juncture stands disposed of directing the respondents to ensure that the petitioner is paid the subsistence allowance regularly on monthly basis in terms of the rules governing the field, at the earliest.
