The applicant has moved this application under Section 439 of the Cr.P.C. for grant of regular bail in connection with Crime No.28/2017 registered at Police Station Kasdol, District Balodabazar for the offence punishable under Section 457, 506, 354(A)(i)(ii) of IPC and Section 8 of the Protection of Children from Sexual Offences Act, 2012.

The applicant has filed this application mainly on the ground that the prosecutrix and all other main witnesses, except Investigating Officer of the prosecution, have been examined and the applicant has remained in jail since January, 2017, therefore, he may be granted bail. 4.
On the other hand, learned State counsel opposed the prayer for grant of bail on the submission that earlier bail application was rejected by this Court, after considering merits of the case.

It appears that the trial is at the verge of conclusion and only Investigating Officer is yet to be examined.

Taking into consideration the submission of learned counsel for the parties, considering the entire circumstances, though I am not inclined to grant bail to the applicant, liberty is reserved to revive, in case, trial is not concluded within a period of three months.
