The applicant has filed this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is in custody since 08.03.2018 in connection with Crime No.102/2018 registered at Police Station : Khursipar, Bhilai, District Durg (C.G.) for the offence punishable under Sections 363, 366, 376 IPC and Section 6 of Protection of Children from Sexual Offence Act.

The prosecutrix is less than 18 years of age, however, her statement would reveal that she has previous acquaintance with the applicant for last about two years and during this period both of them had physical relation on number of occasions.

Considering the quality of evidence available on record, this

Court is inclined to release the applicant on bail. 4.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond of Rs.25,000/- with one surety for the like sum to the satisfaction of the concerned Court for his appearance before it as and when directed.
