1. The applicant has preferred this third application under Section 439 of Cr.P.C. as he is in jail since 25.04.2018 in connection with Crime No. 31/2018 registered in Police Station- Manpur, District Rajnandgaon (CG) for the offence punishable under Sections 376 (2), 294 & 323 of IPC.

2. The first bail application of the applicant was rejected on merits vide order dated 16.05.2019 passed in M.Cr.C. No. 3100/2019 by the coordinate bench of this Court. Thereafter, the applicant had moved the second bail application which was dismissed as withdrawn vide order dated 31.08.2020 passed in M.Cr.C. No. 1730 of 2020 by the same coordinate bench of this Court.

3. Learned counsel for the applicant seeks to withdraw this third bail application, however, he prays for a direction to the trial Court to expedite the trial.

4. Accordingly, the third bail application is dismissed as withdrawn. However, looking to the period of custody of the applicant, the trial Court is directed to expedite the trial and conclude the same as early as possible. Sd/- (Gautam Chourdiya) Judge vatti
