Hon'ble Shri Justice Prashant Kumar Mishra Order on Board /05/2018 1.

The applicants have filed these applications under Section 439 of the Code of Criminal Procedure for grant of regular bail as they are in custody since 07.04.2018 in connection with Crime No.49/2018 registered at Police Station : Pithora, District Mahasamund (C.G.) for the offence punishable under Sections 420 and 120(B) IPC.

The only allegation against the applicants is that while working as salesman in the liquor shop belonging to the Excise Department of the State Government, they consumed some quantity of liquor and to conceal the said act, they adulterated water with the balance quantity of the liquor. 3.

Considering the fact that the offence is triable by the Judicial Magistrate First Class and that the applicants are in jail for more than one month, this Court is of the opinion that it is a fit case to release the applicants on bail.

Accordingly, the applications are allowed and the applicants are directed to be released on bail on their furnishing a personal bond of Rs.25,000/- each with one surety for the like sum to the satisfaction of the concerned Court for their appearance before it as and when directed.
