Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 26/09/2017 The only ground of challenge to the transfer order is that the petitioner having been elected as Office Bearer is entitled to relaxation from transfer for a period of three years in view of policy dated 25/08/2004. Considering that under the said policy, the office bearer of the State level Employees Union are normally exempted from transfer for a period of three years, case of the petitioner requires consideration. It is submitted that representation has not been made by the petitioner. Let the petitioner submit representation within 15 days from today and the competent authority shall consider and take decision within a period of four weeks from the date of receipt of representation.

For a period of six weeks, no coercive steps shall be taken against the petitioner.

The petition is finally disposed off.
