This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.27/2015, registered at Police Station - Chandani, District - Surajpur (C.G.) for the offence punishable under Section 304B/34 of Indian Penal Code. 2.

Case of the prosecution, in brief, is that the deceased, Chandan Kumari was married to this applicant and thereafter, she was subjected to torture for demand of dowry for TV and other articles. Consequently, she committed suicide by pouring kerosene oil and set herself in the fire on 01.08.2015. Thereby, the offence is committed. 3.

Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He would further submit that only general allegations have been attributed to this applicant and mother and father of the applicant has already been enlarged on bail. Therefore, the counsel prayed that the applicant may be enlarged on

On the other hand, learned counsel for the State opposes the bail application.

I have heard learned counsel appearing for the parties and perused the case diary.

Perused the statement of Shivmilan, father of the deceased, wherein direct allegation has been attributed against this applicant. Taking into such statement that the deceased was subjected to torture by this applicant for demand of dowry, who is the husband, this Court is not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
