1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 on behalf of the applicant for grant of regular bail to him as he is in custody in connection with Crime No.340/2016 registered at Police Station- Pulgaon, District - Durg(C.G.) for the offence punishable under Sections 420, 467, 468, 471 & 34 of the Indian Penal Code.

2. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in this case. Applicant is in jail since 23.03.2018. Similarly placed co-accused Virendra Kumar Jaiswal has been granted bail by the co-ordinate Bench of this Court. No offence is made out against this applicant. Hence, it is prayed that he may be released on regular bail.

3. Learned State counsel opposes the bail application and submissions made in this respect. It is submitted that this applicant as a Cashier of S.V. Credit Line Private Ltd. Company has played an important role in the commission of offence, hence, he is not entitled for grant of bail.

4. Heard both the parties and perused the case diary.

5. According to prosecution case, main accused Virendra Kumar Jaiswal got approved loans from S.V. Credit Line Private Ltd. Company for the beneficiaries but the same was never received by the said beneficiaries and this applicant being the Cashier of said company has played active role in disbursement of the said loan amount.

6. Considered on the entire material present in the case diary and the fact that similarly placed co-accused has been granted regular bail, I feel inclined to grant regular to this applicant.

7. Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
