Since both the bail applications are arising out of crime No.444/2021 they are being considered and decided by this common order.

The applicants have preferred these bail applications under Section 439 of CrPC, as they are arrested in connection with Crime No.444/2021, registered at Police Station City Kotwali, Raigarh (CG), for the offence punishable under Section 407, 34 of the Indian Penal Code.

Applicant Sanjeet Kumar Ravi is the driver of vehicle bearing registration No.CG 04 JB 4026 in which 38.100 MT Sponge Iron was loaded from M/s Ind Synergy Limited for being transported to M/s R.S. Ispat Limited, however, in the midway the applicant Sanjeet Kumar Ravi sold one MT Sponge Iron to co-accused Bikky Sarthi and in its place loaded one MT scrap or inferior quality goods. Thus, the allegation is of committing criminal breach of trust as a carrier in respect of one MT Sponge Iron.

Learned counsel appearing for the State, per contra, would oppose the bail applications.

Considering the entire facts situation of the case; the offence is tribal by the JMFC; as also the fact that the applicants are in jail since 22/23-3-2021; and the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicants on regular bail.

Accordingly, both the bail applications are allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
