The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.208/2020, registered at Police Station City Kotwali, Ambikapur, District Sarguja (CG), for the offence punishable under Section 302, 201 & 120-B read with Section 34 of the Indian Penal Code and Sections 25 & 27 of the Arms Act.
3. Applicant along with co-accused Akash Gupta, Siddharth @ Shrawan Yadav & Shiv Patel have allegedly hatched conspiracy to eliminate the deceased namely; Saurabh Agrawal & Sunil Agrawal.
4. As against the present applicant there is allegation and evidence that he purchased the pistol from Shiv Patel and handed over the same to Akash Gupta & Siddharth @ Shrawan Yadav who executed the crime and committed the murder of deceased Sunil Agrawal by firing gun shot and thereafter inflicting knife blows over the abdomen of Saurabh Agrawal. Prosecution has also collected call details finding that all the accused persons were in constant touch with each other just before and on the date of occurrence.
5. Considering the seriousness of the offence and the nature of evidence available on record, this Court is not inclined to grant bail to the applicant.
